Air Emission License
Please be informed that the Agency licenses standby power generators operated by commercial establishments (NOT for household use) as provided for in the Environmental Management Act (Act N0.13 of 2002) CAP20:27 on Section 64.
1. Submit an exhaust emissions test report to the Agency and You can engage a consultant of your own with equipment to do the tests and produces an emissions report (list of consultants here attached, some EIA consultants on our website can also do the tests). The emissions report should also include the emitting facility/generator design specification, exact location and fuel details as required according to Statutory Instrument 72 of 2009, sections 14 and 15.
2. Submit completed Air Emission License application (Form AQ1 here attached) together with the emissions test report.
3. From your submissions in 1 & 2, The Agency may inspect your facility for the physical requirements like the exhaust/chimney designs and exact location in relation to other land uses in the vicinity.
4. After the inspection, the Agency raises a bill for the licence fee. The fees depend on the quality and quantity of your facility/generator emissions, and the emission licences are categorized as Blue (safe) licence, Green (low hazard) licence, Yellow (medium hazard) licence and Red (high hazard) licence.
5. In cases where you do not have the emissions report but have a generator of size above 5kva, SI 72 of 2009 provides that the Agency assume the Emissions are in Yellow Class.
6. Upon payment of the license fee, PLEASE submit your proof of payment to the respective office which issued the bill. The Agency issues the invoice and receipt for your payment.
7. The Agency issues you with an emissions licence for your facility/generator. The licence expires 31st of December every year so you will renew beginning of the year, by the 7th of January.
8. DECOMISSIONED generators do not require emissions licences from the Agency. The whole idea is to manage air pollution, a silent killer, which is being driven by unsustainable power generation methods. The regulation and licensing of air pollutants emitting appliances, including generators, has been in force since the inception of the Agency and is an important tool which ensures that we do not pollute our national ambient air resource.
